Terms of Service

These Terms of Service ("Terms") govern your use of Día de Muertos Mascotas AI at diademuertosmascotas.net (the "Service"), operated by Día de Muertos Mascotas AI ("we", "us"). By using the Service you agree to these Terms. If you do not agree, please do not use the Service.

1. Who can use the Service

You must be at least 18 years old to use the Service and to buy credits.

2. What the Service does

The Service creates a short AI video from a photo of your pet that you upload, inspired by the Día de Muertos tradition of remembering the animals who have passed. You choose a scene, such as your pet crossing a marigold bridge, coming to life on an ofrenda, wearing festive Catrina face paint, or returning to their favorite spot at home, and you can add your pet's name to appear in the video.

Videos are AI-generated tributes, not real footage of your pet. Results depend on the photo you use and may differ from your pet in small details such as markings, proportions or expression.

The Service is an independent tool. It is not affiliated with any government, cultural or religious organisation, or with the makers of the AI models we use.

3. Your account

You sign in with your Google account. You are responsible for activity on your account. Tell us right away at support@diademuertosmascotas.net if you think someone else has used it.

4. Photos you upload

By uploading a photo you confirm that:

• you own the photo or have permission to use it;
• the photo shows an animal, with no people in it.

You must not upload photos of people, nude or sexual images, images of animal cruelty, or images meant to harass, deceive or break anyone's rights. We may remove content and suspend accounts that break these rules.

You keep your rights in your photos. You give us a limited licence to store and process them only to create your videos and run the Service.

5. Videos you create

You may download your videos and keep or share them for personal use: on your ofrenda, with your family, or on social media. You are responsible for how you share them. Do not present a video as real footage of your pet, and follow each platform's rules on labelling AI-generated content.

Videos are delivered without sound. If you add music, make sure you are allowed to use it where you post.

6. Credits and payments

• Making a video uses credits. Each video costs the number of credits shown next to the create button.
• Credits are sold in one-time packs through Stripe. There is no subscription and nothing renews automatically. Prices are shown in US dollars and may change, but never for a pack you have already bought.
• Credits do not expire, cannot be transferred, and have no cash value.
• If a video fails, its credits are returned to your balance automatically.

Refunds are covered by our Refund Policy.

7. Acceptable use

Do not misuse the Service. In particular, do not try to break, overload or reverse engineer it, scrape it, get around payments or credit limits, or use it to break the law or anyone else's rights.

8. Intellectual property

The Service, its design, its illustrations and its software belong to us. Día de Muertos is a cultural tradition that belongs to everyone who celebrates it; we refer to it only to describe the videos.

9. Suspension and ending the Service

We may suspend or close an account that breaks these Terms. You can stop using the Service at any time and ask us to delete your account by emailing support@diademuertosmascotas.net.

10. Disclaimers

The Service is provided "as is" and "as available". We do not promise that it will always be available, error-free, or that every video will look exactly like your pet.

11. Limitation of liability

To the fullest extent allowed by law, we are not liable for indirect, incidental or consequential losses, and our total liability for any claim relating to the Service is limited to the amount you paid us in the three months before the claim.

12. Changes to these Terms

We may update these Terms. We will change the "Last updated" date above, and if a change is significant we will tell you on the website. Using the Service after a change means you accept the updated Terms.

13. Governing law

These Terms are governed by the laws of the Hong Kong Special Administrative Region, without regard to its conflict-of-law rules. Nothing in these Terms takes away rights you have under the consumer laws of the country where you live.
